Each state manages pay transparency and salary history for job applicants differently. Use the chart below to determine whether additional requirements apply to your operation.
States could have laws relating to pay transparency (requiring employers to disclose pay information to job applicants for open positions), salary history bans (prohibiting employers from asking applicants about their pay history), or both.
If no state law exists, the federal Equal Pay Act will be the only law that applies.
If a state law does exist, both the state law and the federal law can apply. Applicants are generally entitled to whichever provision in each law gives them the greatest protection.
