Pay transparency
Colorado employees must be informed of all promotion opportunities worldwide (even if an employee is unqualified for the position being offered).
If an employer posts a job to be performed in Colorado, or that can be performed remotely from anywhere, the compensation range for the position and descriptions of incentive compensation and benefits must be included in the job posting.
Temporary hires who work no more than six months who are not expected to be made regular employees are not included in the job posting requirement. However, if the temporary hire may become permanent, the required promotion posting must be made in time for employees to apply for the permanent position.
Salary history
An employer in Colorado may not ask prospective employees for their wage rate histories, nor rely on wage history to determine a wage rate. Employers may not retaliate or discriminate against a prospective employee who does not disclose their wage history. Prior wage rate history may not be relied upon to justify a disparity in current wage rates. This applies to any employer with at least one employee in Colorado.
