Pay transparency
There are no state-wide laws regarding pay transparency in New Jersey.
Salary history
In New Jersey, employers may not screen job applicants based on their salary history, nor require an applicant's salary history to meet minimum or maximum criteria. If a job applicant voluntarily without coercion discloses pay history, the employer may verify that information as well as consider pay history when determining that applicant's compensation.
After an employment offer is made that includes an offer of compensation, an employer may request that applicants provide written authorization to confirm pay history. An applicant's refusal to provide salary history shall not be used against them in employment decisions.
