Pay transparency
Illinois state law requires employers with 15 or more employees to include pay scale and benefits in any job posting. A hyperlink to a publicly viewable webpage that includes this information is acceptable. The law applies to employers whose employees are based in Illinois, and to remote employees from other states who report to supervisor, office, or other work site located in Illinois.
If a job posting has not been made available, employers must disclose pay scale and benefits to any applicant prior to any offer or discussion on compensation and at the applicant's request.
All opportunities for promotion must be made known to current employees within 14 days of a position being posted externally.
Salary history
Illinois employers may not ask about the wage or salary history of job applicants and may not use an applicant’s salary history in determining salary, benefits, or other compensation. Employers may engage in discussions with applicants regarding their compensation expectations. An applicant may voluntarily disclose salary history information, but employers may not rely on such disclosures to determine future wages, nor use the information to determine whether to make an offer of compensation to that applicant.
