Pay transparency
In Hawaii, employers with 50 or more employees who post job listings must post the hourly rate or salary range that reasonably reflects what the employer expects to pay for that position. Advertisements require a range of pay to be listed regardless of how or where they are posted. The law does not require wage/salary information to be posted for internal transfers or promotions within the company.
Salary history
Employers in Hawaii are prohibited from asking about the salary history of job applicants, and from using salary history in determining salary, benefits, or other compensation. If an applicant voluntarily discloses salary history information, then an employer may consider that history in determining salary, benefits, or other compensation, and the employer is allowed to verify that applicant’s salary history. Employers may engage in discussions with applicants regarding compensation expectations.
