Pay transparency
Maryland state law requires employers to provide job applicants with the wage range and a general description of any benefits or other compensation for each public or internal job posting. If such information was not previously given to an applicant, the employer must disclose the information before any compensation discussion is held with the applicant, and/or upon applicant request. Employers may not refuse to interview, hire, employ, promote, or transfer an employee for requesting the wage range of a position for which they have applied.
Salary history
In Maryland, employers may not seek wage history from an applicant. Employers may not refuse to interview, hire, promote, or employ an applicant, or retaliate against an applicant, because the applicant did not provide wage history, or requested a wage range for the position for which the applicant applied. Employers may not rely on an applicant’s wage history when screening the applicant for employment or when determining wages for that applicant. After an initial employment offer has been made, an applicant may volunteer wage history to support a wage offer higher than what was initially offered by the employer.
