Pregnant Workers Fairness Act information tough to spot on poster
If you’re using a checklist to make sure you’re meeting posting obligations for anti-discrimination laws like the recently enacted Pregnant Workers Fairness Act (PWFA), you might have a tough time figuring out where those laws are mentioned on your labor law poster.
The information is there on the Know Your Rights posting from the Equal Employment Opportunity Commission (EEOC), but you wouldn’t know that from a quick glance.
When the EEOC replaced the Equal Employment Opportunity (EEO) is the Law poster with the Know Your Rights poster last year, it reworded the poster to explain employee rights in simpler language. In doing so, it took the names of specific laws off the poster.
Poster lists protections
Instead of mentioning Title VII of the Civil Rights Act or the Genetic Information Nondiscrimination Act (GINA), the Know Your Rights poster lists the protections those laws provide. It notes that employers may not discriminate against employees based on race, color, religion, sex, national origin, or genetic information, but does not list the laws these rights stem from.
Most recently, the agency updated the poster with information about the Pregnant Workers’ Fairness Act (PWFA). The act itself isn’t mentioned, but the rights it provides are mentioned in two areas:
- In the section What Types of Employment Discrimination are Illegal? the poster includes “Interference coercion, or threats related to exercising rights regarding disability discrimination or pregnancy accommodation.”
- In the section What Employment Practices can be Challenged as Discriminatory? the poster lists “Conduct that coerces, intimidates, threatens, or interferes with someone exercising their rights or someone assisting or encouraging someone else to exercise those rights, regarding disability discrimination (including accommodation) or pregnancy accommodation.”
The Know Your Rights poster is required for employers with 15 or more employees, as anti-discrimination protections under the PWFA and other laws take effect when an employer reaches that threshold.
Even though the PWFA and other laws are not specifically mentioned on the Know Your Rights poster, it is the poster that fulfills an employer’s obligation to post a notice describing employee rights under federal laws prohibiting job discrimination.
The EEOC notes that it must be displayed, and that employers face a fine of $659 if they fail to post it.
Which laws are summarized on the Know Your Rights poster?
The Know Your Rights poster summarizes information about:
- Title VII of the Civil Rights Act
- Title I and Title V of the Americans with Disabilities Act
- The Age Discrimination in Employment Act
- The Equal Pay Act
- The Pregnant Workers’ Fairness Act (PWFA)
- The Genetic Information Nondiscrimination Act (GINA)
It also includes summaries of these laws which must be posted by federal contractors:
- Executive Order 11246
- Section 503 of the Rehabilitation Act
- The Vietnam Era Veterans Readjustment Assistance Act
In addition, the poster summarizes these laws that apply to programs or activities receiving federal financial assistance:
- Title VI of the Civil Rights Act
- Title IX of the Education Amendments of 1972
- Section 504 of the Rehabilitation Act
Key to remember: The Know Your Rights posting summarizes employee rights under anti-discrimination laws. While it does not list the names of specific laws, the EEOC indicates that the poster fulfills an employer’s obligation to post information about laws that protect employees from workplace discrimination.
