Pregnant worker regulations require display of Know Your Rights posting
The Pregnant Workers Fairness Act (PWFA) regulations recently published by the Equal Employment Opportunity Commission (EEOC) mention a workplace poster, but it’s one that employers should already have on the wall.
The Know Your Rights: Workplace Discrimination is Illegal posting was updated on June 27, 2023, with information about the PWFA. The poster’s release last year coincided with the effective date of the law.
The law’s regulations, issued on April 15, note that employers are obligated to display a new equal employment opportunity poster. A footnote explains that the poster that needs to be displayed is the Know Your Rights posting that was updated in 2023.
Employers with 15 or more employees should make sure this poster is displayed in a conspicuous location.
Where is the PWFA information on the Know Your Rights poster?
While displaying the Know Your Rights posting fulfills an employer’s obligation to post information about the PWFA, the text on the poster doesn’t mention the act by name.
Instead, pregnancy and related conditions are mentioned in the section titled “What Employment Practices can be Challenged as Discriminatory?” The poster notes that “Failure to provide reasonable accommodation for a disability, pregnancy, childbirth, or related medical condition” could be discriminatory.
In addition, the poster mentions pregnancy accommodation in two places:
- The section listing types of employment discrimination includes interference, coercion, or threats related to exercising rights regarding pregnancy accommodation; and
- The section listing practices that could be challenged as discriminatory mentions conduct that intimidates, threatens, or interferes with someone exercising their rights, or someone assisting or encouraging someone else to exercise their rights, regarding pregnancy accommodation.
The absence of the act’s name on the poster is in keeping with its conversational tone. An older version of the EEOC’s workplace poster (Equal Employment Opportunity is the Law) listed each act the poster covered (such as Section VII of the Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, GINA, etc.).
The new Know Your Rights poster does not list the names of the specific laws. Instead, it talks about employee rights in more general terms.
This makes the poster more readable for employees, but does require employers to do a little more thinking when making sure they are fulfilling all their PWFA obligations.
Is a separate PWFA poster required?
Because the EEOC includes information about the PWFA and other laws it oversees on the Know Your Rights poster, a separate PWFA poster is not required.

The supplementary materials do not need to be posted, however. The only required workplace posting from the EEOC is Know Your Rights: Workplace Discrimination is Illegal.
