PHMSA requests information on electronic hazmat shipping papers
The Pipeline and Hazardous Materials Safety Administration (PHMSA) published a Request for Information (RFI) on the potential use of electronic communication (shipping papers) as an alternative to current physical (hard copy, paper) documentation. The RFI is seeking input to the benefits and issues with permitting hazardous materials documentation to be provided/transmitted electronically instead of in a physical form. The RFI is considering all forms of documentation required by the HMR including:
- Shipping papers (Part 172, subpart C)
- Emergency Response information (Part 172, subpart G)
- Train Consists ( 174.26)
- Notifications to Pilot in Command ( 175.33)
- Dangerous cargo manifests ( 176.30)
- Shipping papers in motor vehicles ( 177.817)
The RFI also addresses documents that accompany shipments that may not have a direct emergency response purpose, but either commonly accompany shipments or are present on transportation vehicles, including:
- Special permits
- Approvals
- Registration
PHMSA is accepting comments on the RFI until September 9, 2022. Comments can be submitted online under Docket # PHMSA-2022-0043 at the regulations.gov website.
Questions
PHMSA lists two categories of questions they would like responses for in the RFI. The first category is for emergency response and inspection organizations. The second category is for shippers, carriers, and logistics facilitators. Below is an abbreviated list of questions from each category.
Emergency Responders & Inspectors:
- What type of inspection or emergency response organization do you represent?
- What level of hazardous materials response training do you have?
- List or identify any major transportation hubs that handle hazardous materials or routes contained in your response or inspection area.
- Approximately what percentage of your response or inspection area is covered by a wireless technology network that supports portable electronic devices capable of communications, data processing, and/ or computing?
- Do you support the use of electronic hazard communication as an alternative to the current paper requirements? Please provide your reasoning.
Shippers, Carriers, and Logistics Facilitators:
- Provide a general description of your activities as related to the transportation of hazmat.
- What percentage of your business involves offering, transporting, or third-party facilitation of hazmat shipments?
- Would you consider implementing electronic hazard communication if the HMR authorized it as an option?
- What value could you gain by using electronic hazard communication?
- Do you have concerns with government agencies having permanent, historical access to the database, rather than access only during transportation?
- How would implementation of electronic hazard communication by other entities in the supply chain affect your ability to conduct your business activities if you choose to continue to operate using a paper-based concept of operations?
The RFI lists several other questions and considerations to think about and comment on.
Next steps
A request for information is one of the actions in the rulemaking process. The public comments submitted in response to this RFI will provide PHMSA with an understanding of stakeholders needs, concerns, and the potential challenges of implementing an electronic hazard communication system.
When the comment period ends on September 9, 2022, PHMSA will evaluate input from all stakeholder comments. Once PHMSA has evaluated the information, they could hold public meetings to further discuss any stakeholder concerns and potential rule. After PHMSA has all the information necessary, they could publish an Advance Notice of Proposed Rulemaking.
