PHMSA increases safety measures for trains with hazmat
A recent change requires railroads to proactively provide first responders with real-time, electronic information about hazmat shipments by rail to the primary Public Safety Answering Point (PSAP) as soon as the railroad is aware of an accident or incident involving hazardous materials. The Pipeline and Hazardous Materials Safety Administration (PHMSA) amended the Hazardous Materials Regulations (HMR) to better protect emergency responders and increase public safety.
Final rule HM-263 requires all railroads to generate, in hard copy and electronic versions, real-time train consist information for shipments containing hazardous materials. Required information includes the quantity and position of the hazardous materials on the train, the train’s origin and destination, emergency response information, and a designated emergency point of contact at the railroad.
Amendments in this final rule address safety recommendations from the National Transportation Safety Board and statutory mandates in The Fixing America’s Surface Transportation Act. These changes become effective on July 24, 2024, with mandatory compliance for Class I railroads beginning on June 24, 2025.

- Removing the definition of "Train consist" and replacing it with "Train consist information means a hard (printed) copy or electronic record of the position and contents of each hazardous material rail car in a train where the record includes information required by §174.26".
- Updating the requirements for the Notice to Train Crews. Specifically, PHMSA clarifies:
- The railroads must provide a local printed paper copy version of train consist information to train crews,
- Train crews must update the local copy version of train consist information and that the local copy of the train consist information must be maintained in a conspicuous location of an occupied locomotive or in the possession of a train crew member if they evacuate the locomotive during an accident or incident,
- Railroads must ensure that train consist information is generated and updated in electronic form that is maintained offsite of the train itself and immediately accessible by the railroad’s designated emergency response point of contact,
- Railroads must keep the local printed paper copy and electronic train consist information maintained off the train are at all times accurate and consistent.
- Creating a new section in §174.28 that establishes real-time, electronic train consist information-sharing requirements for hazardous materials transported by rail. Specifically, require railroads transporting hazmat to create electronic train consist information and provide it to authorized federal, state, and local officials who could be involved in the response to, or investigation of an accident, incident, or public health or safety emergency involving the rail transportation of hazardous material, including:
- First responders,
- Emergency response officials, and
- Law enforcement personnel.
- Immediately following an accident or suspected release of hazmat from a train, the railroad operating the train must make an emergency telephone notification to the primary Public Safety Answering Point and provide the train consist information electronically.
Additionally, PHMSA is requiring railroads to develop a test program and conduct tests of their emergency notification and electronic train consist transmission system at least annually, to ensure reliability of these systems across their network.
