Falling for posting updates: Display the latest versions in these six states
Autumn is not typically a popular season for mandatory posting changes. But the six mandatory state posting changes in effect during September and October 2024 show that updates can occur at any time of year.
If you have locations in these states, make sure to display the most recent version of the updated postings:
- Florida: The state minimum wage posting has been updated with the rate of $13 per hour which is in effect from September 30, 2024, to September 29, 2025. The poster also shows the new tipped wage of $9.98 per hour.
- Massachusetts: The workers’ compensation Notice to Employees from the Department of Industrial Accidents has been updated to note than an employee may file a claim on Form 110 if the employer fails to report the injury to the insurer.
- New Hampshire: The state has released a new Veterans’ Benefits and Service posting that must be displayed by all employers. The posting contains contact information for the New Hampshire Department of Military Affairs and Veterans Services as well as health care, substance abuse and mental health treatment resources, and other information for veterans.
- Oklahoma: The Oklahoma Office of Civil Rights Enforcement updated the Oklahoma Law Prohibits Discrimination posting to remove information about appeal procedures available through Oklahoma Merit Protection, which has been eliminated.
- Tennessee: The Unemployment Insurance posting was updated by the Department of Labor and Workforce Development with changes to benefits eligibility information. To be eligible for benefits, an individual must complete at least four work search activities each week. Previously, three weekly work searches had to be conducted.
- West Virginia: WorkForce West Virginia revised the Notice to Employees – Unemployment Benefits posting to update work search information. Individuals who are unemployed must complete four work search activities each week. Previously, no number of work search activities was specified. The search activities must be documented.
How to comply
Labor law posters containing up-to-date information must be displayed in an area of a facility where all on-site employees can easily view them. This could be near an employee entrance, in a break room, or near a time clock.
The trend toward requiring electronic display of labor law posters continues to grow. Electronic posters are always highly recommended when an employer has remote workers. In some cases, it is a requirement to make labor law posters available to remote workers, and electronic posting is an effective way to do this. For example, the Massachusetts Notice to Employees, must be made available to remote employees.
Key to remember: Mandatory posting changes can occur at any time of year, and employers must update their posters when new versions are available.
