2 reasons to watch for mandatory federal posting updates
In the next few months, two new laws are likely to bring mandatory labor law posting changes. Here’s what’s likely to change and how to prepare:
Fair Labor Standards Act poster: PUMP for Nursing Mothers Act
The Provide Urgent Maternal Protections for Nursing Mothers Act (PUMP Act) took effect on December 29, 2022, and gives more nursing employees the right to a private space and break time to express breast milk at work.
This right was already available to employees who are eligible for overtime under the Fair Labor Standards Act (FLSA). The new law extends this right to most employees, including those who are exempt from overtime.
Employers with fewer than 50 employees are exempt from the requirement if complying would impose an undue hardship, and there are some exceptions for airline, railroad, and motorcoach employees.
To reflect the updated law, the Nursing Mothers section of the Employee Rights Under the Fair Labor Standards Act poster will need to be updated to remove wording that notes that the law only applies to “a nursing mother employee who is subject to the FLSA’s overtime requirements.” As of April 28, 2023, workers have additional recourses when their rights under the law are violated. This information may be added to the poster as well.
Know Your Rights poster: Pregnant Workers Fairness Act
The Pregnant Workers Fairness Act will take effect on June 27, 2023. It will require covered employers to provide reasonable accommodations when an employee requires them because of pregnancy, childbirth, or a related medical condition, unless the accommodation would cause undue hardship to the employer.
Under current law, employers cannot fire or discriminate against employees on the basis of pregnancy, childbirth, or related medical conditions. The new law requires reasonable accommodations to be considered.
Information about these accommodations will be added to the Know Your Rights: Workplace Discrimination is Illegal posting from the Equal Employment Opportunity Commission (EEOC). This poster must be displayed by employers with 15 or more employees.
How to prepare for mandatory labor law poster updates
The EEOC indicates it is working on the mandatory poster update, and will release the revised Know Your Rights poster before the law takes effect in late June. Employers should watch for information about the updated poster to be released closer to the law’s June effective date. The Department of Labor (DOL) has not yet announced a timeline for updating the FLSA poster, but employers should watch for news of an updates.
After the new posters become available, they should be posted in a conspicuous location where they are visible to employees. Electronic versions of the posters can be posted online for remote workers.
