Two mandatory federal posting changes are here: Are you ready to comply?
The Department of Labor (DOL) and Equal Employment Opportunity Commission (EEOC) have made mandatory changes to workplace postings:
- The Employee Rights Under the Fair Labor Standards Act (FLSA) posting from the DOL has been updated with information relating to the Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act. Employers must post the April 2023 version.
- The Know Your Rights: Workplace Discrimination is Illegal posting from the EEOC has been updated with information about employee rights under the Pregnant Workers Fairness Act (PWFA). When the law takes effect, employers must post the June 27, 2023, version.
Who needs updated posters?
Almost all employers are covered by the FLSA and need to display the updated April 2023 Employee Rights poster. This includes:
- Employers with an annual dollar volume of sales or business done of at least $500,000,
- Medical providers, schools, and preschools,
- Public employers and government agencies, and
- Employees with workers engaged in interstate commerce or produce goods for interstate commerce.
Employers with 15 or more employees must post the updated Know Your Rights poster from the EEOC.
What’s new on the FLSA posting?
The updated posting includes information about the PUMP Act. . This law was signed in December 2022 and enforcement provisions took effect in April.
The section of the FLSA poster previously called Nursing Mothers is now called Pump at Work.
The poster notes that the law requires employers to provide reasonable break time for a nursing mother to express breast milk and must provide a place, other than a bathroom, that is shielded from view which may be used by the employee.
Previously, the poster stated that this right to break time only applied to employees subject to the FLSA’s overtime requirements (i.e., nonexempt “hourly” workers).
The poster has an April 2023 revision date in the lower right corner.
What’s new on the Know Your Rights posting?
The revised Know Your Rights poster contains new information about employee rights under the PWFA. The poster has a revision date of June 27, 2023, the date the new law takes effect.
The updated poster notes that:
- Employers may not discriminate against employees on the basis of pregnancy, childbirth, or related medical conditions.
- Failure to provide reasonable accommodations for pregnancy, childbirth, or related medical conditions can be discriminatory.
The EEOC has also added information about threatening workplace conduct. The updated poster lets employees know that:
- Discriminatory conduct can include behaviors that coerce, intimidate, threaten, or interfere with someone exercising their rights, or someone assisting or encouraging someone else to exercise their rights regarding disability discrimination or pregnancy accommodation.
- Interference, coercion, or threats related to exercising rights regarding disability discrimination or pregnancy accommodation is an illegal type of employment discrimination.
Why are new FLSA and Know Your Rights posters required?
Employers must display the latest versions of the FLSA and Know Your Rights postings because they have been revised to reflect regulatory changes.
The updated versions make employees aware of their current rights under these laws, and the DOL and EEOC require employers to post them.
FMLA poster revised as well
The DOL also updated the Family and Medical Leave Act (FMLA) posting with a new look, but covered employers displaying previous versions remain in compliance.
The April 2023 version uses a question-and-answer format to explain the law. It also contains a QR code that can be scanned for additional information.
There has been no change to the law, however, so previous versions remain compliant. Employers covered by the FMLA may display either the 2023, 2016, or 2013 versions.
It’s update time for all-in-one posters
Many employers display labor law posters in an all-in-one format, using a poster that contains all commonly required federal postings.
To remain compliant, these posters should now be updated with the latest posters from the DOL and EEOC.
Key to remember: Covered employers must display the April 2023 version of the Employee Rights Under the Fair Labor Standards Act posting and the June 27, 2023, version of the Know Your Rights: Workplace Discrimination is Illegal posting.
