PHMSA issues packaging tape enforcement discretion
The Pipeline and Hazardous Materials Safety Administration (PHMSA) has issued a notice of enforcement discretion regarding packaging tape used to close non-bulk hazmat packagings. The notice temporarily allows shippers to use tape other than what is specified in the package manufacturers closure instructions due to supply chain issues. The notice of enforcement discretion is valid through August 31, 2022.
Requirements
PHMSA is allowing the closure of UN specification packaging with tape that was not specifically used in the testing and certification process provided the adhesive tape is:
- The same material as the tape in the original packaging test report;
- Capable of demonstrating no diminished capabilities in yield strength, thickness, ductility, width, length, or adhesive properties; and
- Compatible with the packaging.
Any deviation used to close and secure the packaging should be documented with instructions on how to close the packaging with the alternative tape. The documented information must include any procedures to be followed, including closure instructions for inner packagings and receptacles to effectively assemble and close the packaging to prevent leakage during transportation.
Reasoning
Tape manufacturers in the U.S. are currently unable to keep up with demand due to supply chain issues and labor shortages resulting from the Covid-19 pandemic. Some of the supply chain issues stem from the availability of raw materials, slowed production due to staffing issues, and ability to procure transportation. As a result, PHMSA acknowledges that members of the regulated community are having difficulty acquiring the types of packaging tape needed to meet non-bulk packaging certifications.
Normally, PHMSA requires that any changes in tape – such as a different brand or adhesive properties – would invalidate the UN certification unless the packaging was tested and certified with the new tape. Unfortunately, retesting and certifying alternative tape takes time and would come at a significant cost to the industry. Issuing the enforcement discretion provides much needed relief to shippers and manufacturers that cannot obtain the exact tape that was certified with the packaging.
