PHMSA terminates hundreds of explosive approvals
On Wednesday, June 14, 2023, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a notice that terminated 484 Explosive (EX) approvals. The notice of termination titled: “Hazardous Materials: Notification of Termination of Certain Explosive Classification Approvals Due to Non-Compliance With the UN Model Regulation Test Series 6(d) Requirement,” as the title suggests, terminates the EX approvals for not complying with test requirements.

Why terminate so many EX approvals?
Final rule HM–215O amended Special Provision 347 to require successful completion of UN 6(d) testing. This change affected explosives classified as Division 1.4S hazardous materials and impacted ID Numbers UN0349, UN0367, UN0384, and UN0481. The testing requirement became effective on May 10, 2021.
PHMSA attempted to contact the affected approval holders in October 2020 via a Safety Advisory Notice issued from the PHMSA EX Portal to alert holders of the May 10, 2021, compliance deadline. On May 4, 2021, PHMSA issued a second Federal Register Notice, which notified the approval holders of PHMSA’s intent to terminate all approvals that failed to provide PHMSA with documentation showing that the UN 6(d) test had been successfully completed by June 3, 2021.
The approval holders failed to submit evidence that the UN 6(d) testing had been successfully completed and failed to apply for a modification of their approval. Therefore, PHMSA terminated 484 approvals, effective June 3, 2021.

What is an EX approval?
EX Approvals are classification documents that:
- Give written consent, including competent authority approval, from the Associate Administrator for hazardous Materials Safety or other designated official, to perform a function that requires prior consent under the Hazardous Materials Regulations,
- Are issued to ensure the safe transportation of hazmat (explosives/fireworks); and
- Assign the proper shipping name, hazard class, UN identification number, and EX Approval number for the fireworks device.
EX numbers:
- Are issued by the Associate Administrator for hazardous Materials Safety or his designated official,
- Are required prior to transportation into/within the U.S., and
- Must be placed on the packaging or shipping papers.
What happens if our EX approval was terminated?
If you are no longer shipping an explosive that requires an EX approval, you do not need to do anything. However, if you are shipping an explosive that requires the EX approval and it was terminated, you would need to reapply for another approval.
EX approvals can be submitted electronically through the PHMSA Portal at https://portal.phmsa.dot.gov.
