PHMSA reinstates hand sanitizer enforcement policy
After indicating they would not extend the hand sanitizer enforcement policy, the Pipeline and Hazardous Materials Safety Administration (PHMSA) is doing an about-face and will reinstate the policy. The enforcement policy is intended for offerors and carriers who offer, or transport hand sanitizers manufactured and packaged prior to October 31, 2020, and in accordance with the previous Notices of Enforcement Discretion that were issued on April 10, 2020 and June 24, 2020. The extended enforcement discretion will continue through March 31, 2021.
Why reinstate the policy?
Hand sanitizer manufacturers are currently required to comply with all applicable hazardous materials regulations since the last enforcement policy expired on October 31, 2020. However, it was discovered that some hand sanitizers manufactured and packaged under the previous Notice of Enforcement Discretion have not yet been delivered to end users.
To facilitate a continued response to the COVID-19 public health emergency, PHMSA reinstated and extended the Notice of Enforcement Discretion to offerors and carriers who offer or transport hand sanitizers manufactured and packaged prior to October 31, 2020, and in accordance with the previous Notices of Enforcement Discretion.
Previous notice of enforcement requirements
For transportation of hand sanitizers in small packaging, PHMSA will not take enforcement action for violations of the HMR when the following procedures are followed:
- Hand sanitizer cannot exceed 80 percent ethyl alcohol or isopropyl alcohol.
- Packages are leak tight, secured against shifting, and protected against damage.
- Package cannot exceed 8-gallon capacity.
- For inner packages not exceeding 1 gallon:
- Must be a combination package with the inner receptacles placed upright and cushioned within the outer packaging to prevent breakage, leakage, and movement.
- Contents of all inner package in a single outer package cannot exceed 8 gallons.
- The company name and the words “Sanitizer - Contains Ethyl Alcohol” or “Sanitizer - Contains Isopropyl Alcohol” are marked on the outer package.
- Packages exceeding a capacity of 1 gallon:
- Are overpacked in crates, cages, carts, boxes, or similar overpacks.
- Packages are upright and secured to prevent breakage, leakage, and movement.
- The company name and the words “Sanitizer - Contains Ethyl Alcohol” or “Sanitizer - Contains Isopropyl Alcohol” is marked on the outside of the single package and the overpack.
For larger quantities PHMSA will not take enforcement action for violations of the HMR for shipments of packages exceeding 8 gallons but not more than 119 gallons of sanitizer, if the following procedures are followed:
- Hand sanitizer cannot exceed 80 percent ethyl alcohol or isopropyl alcohol.
- Packages are leak tight, secured against shifting, and protected against damage.
- Package capacity cannot exceed 119 gallons.
- The packaging must be DOT or United Nations (UN) specification packaging (drums, jerricans, etc.) described in 173.202 meeting the Packing Group (PG) II performance standard.
- PHMSA registration requirements do not apply.
- Offerors and transporters must provide employees with PHMSA approved training materials.
- Each package is labeled with a flammable liquid label.
- The shipping paper must include the following basic description “UN1987, Alcohols, n.o.s., Class 3, PG II” and indicate the number, type, and capacity of packages offered.
- A copy of the Emergency Response Guidebook Guide number 127 accompanies the shipment.
- The vehicle must be placarded if gross weight of hand sanitizer meets or exceeds 1,001 pounds.
- All motor carriers comply with 177.804.
Key to remember: The enforcement policy only applies to hand sanitizer manufactured and packaged in accordance with previous Notices of Enforcement. The extended enforcement discretion will continue through March 31, 2021.
