Go to school on federal school bus rules and exceptions
A shortage of school bus drivers has impacted many of the 14,000 school districts in the United States. The Federal Motor Carrier Safety Administration (FMCSA) recognizes the need to recruit and train school bus drivers.
The “under the hood” portion of the commercial driver’s license (CDL) skills test is temporarily relaxed.
There are also permanent exemptions for school bus drivers operating buses between schools and students’ homes, but these do not apply to after-school activities, such as driving team buses to sporting events.
The following is a brief review of federal rules applicable to school bus operations.
“Under the hood” temporary waiver
To more easily recruit intrastate drivers seeking their CDL and the school bus or “S” endorsement, FMCSA made it optional for states to waive the “under the hood” portion of the pre-trip inspection during the CDL skills test through September 30, 2022. This was the second 90-day extension of the waiver which originally started January 3, 2022. These school bus drivers were not required to identify engine components which are “under the hood”.
On October 27, 2022, FMCSA subsequently granted the National School Training Association (NSTA) a two-year waiver effective November 27, 2022, through November 27, 2024, from the same under-the-hood portion of the CDL skills test for intrastate-only (K-restriction) drivers seeking their CDL with a school bus or “S” endorsement .
NOTE: Drivers issued a CDL under this waiver are restricted to the intrastate operation of a school bus only (no other CDL vehicles) and exclusively in the state that issued the CDL. A driver that currently holds a “P” endorsement would be tested with current procedures for the “S” endorsement and cannot use the “under-the-hood” waiver.
The states are allowed to waive the under-the-hood requirement (see 49 CFR 383.133(c)(1)) in accordance with a pre-approved examiner information manual.
The drivers must still pass all other parts of the CDL written and road tests.
Permanent exceptions
Under the Federal Motor Carrier Safety Regulations (FMCSRs), a “school bus” is a passenger motor vehicle designed or used to carry a driver plus 11 or more passengers and is primarily used to transport pre-primary, primary, or secondary-school students between home and school.
School buses that operate between a school and students’ homes — are exempt from the FMCSRs under 390.3(f)(1), except for the bans on texting and hand-held cellphone use as well as CDL (Part 383) and drug and alcohol testing (Part 382) requirements.
School buses operated by the government, such as a school district, are exempt from the FMCSRs except for CDL and drug testing rules under 390.3(f)(2) unless specifically excepted by the state. This exemption does not extend to contractors performing transportation on behalf of the government.
However, for-hire school buses used to transport post-secondary students or for travel to extracurricular activities across state lines are subject to federal rules.

Rules applicable to operation types
Rules are applied differently depending on the aspects involved, including:
- A government entity or for-hire contractor,
- Public or private school,
- Regular school or extracurricular activities, and
- Primary or post-secondary school.
The following table outlines how the FMCSRs in Parts 382 and 383, and Parts 390 through 396 apply to school-bus operations:
