Does the March 15 MIS reporting deadline apply to you?
The Management Information System (MIS) annual reporting requirements can be a source of confusion and frustration. Many carriers have fallen victim to misunderstandings, leading to missed data submissions or mistakenly trying to report when they don't need to. But here's the catch: failing to meet the deadline for providing drug and alcohol data to the Federal Motor Carrier Safety Administration (FMCSA) can result in hefty fines of up to $1,000 per day.
Are we subject to the MIS form?
Not every motor carrier is required to submit the MIS form. FMCSA collects information from a segment of truck and bus companies who operate commercial motor vehicles requiring a commercial driver’s license (i.e., subject to Part 382). Specifically, the agency requires the MIS submission from:
- A random sample of carriers with fewer than 1,000 drivers, and
- All companies with 1,000 or more drivers.
How will we know if we’re selected?
FMCAS notifies motor carriers of the reporting requirements through an email. In the event the email Is not deliverable, the motor carrier will receive notification via physical mail.
This notification includes a username and password, so the carrier has access to complete an online summary report or downloadable form.
If you are not contacted by the agency, you’re not required to provide information on your DOT testing program. In fact, you won’t have a means to submit data.
What is the deadline for completion?
If contacted by FMCSA, you have until March 15th to either complete the summary of your previous year's drug and alcohol results or respond to the notice you received.
You may use a consortium/third-party administrator to help submit the MIS report on your behalf. But your motor carrier is still responsible for the information provided in the report. A company official, such as your designated employer representative, must certify to accuracy and completeness of the submission no matter who prepares it.
What does FMCSA do with the MIS data?
The annual collection of DOT drug and alcohol testing data helps identify whether the positivity rate of drug and/or alcohol testing has changed substantially. These trends can result in the raising or lowering of the minimum annual random drug or alcohol testing rates in 49 CFR 382.305.
Do we need a Login.gov account to complete the MIS form?
Yes, a new federal mandate to secure federal databases requires a Login.gov account. Anyone needing access to a government system, such as the MIS website, needs at least one user set up with the authentication method.
Without the Login.gov account, you are unable to submit your drug and alcohol testing data. You may already have someone within the organization with an account since it’s also required to have access to FMCSA’s portal.
Key to remember: Motor carriers will be contacted by FMCSA if they are required to submit a summary of last year’s drug and alcohol testing by March 15th.
