On January 26, The Michigan Court of Appeals decided that the MI Paid Medical Leave Act (PMLA), as implemented in March 2019, will remain in place, even beyond 2/20/23. Therefore, employers need not comply with the Earned Paid Sick Leave provisions that were expected to take the place of the PMLA as of 2/20/23.

As background on the changes, on July 29, 2022, the Michigan Court of Claims issued a stay of its July 19, 2022, decision, which delayed the changes, and an appeal to the Michigan Court of Appeals ensued. The stay was set to expire on February 19, 2023.

Instead, employers may continue complying with the MI PMLA until further litigation. This issue is expected to go to the MI Supreme Court, so stay tuned.

The case is Mothering Justice v. Nessel.
