CSA update includes new violations, ELP alignment
Recent changes to the Compliance, Safety, Accountability (CSA) measurement system will affect some carriers’ Unsafe Driving scores and change the way English-language proficiency (ELP) violations are categorized.
The Federal Motor Carrier Safety Administration (FMCSA) first made the changes public in mid-October but they went into effect almost three months earlier, on July 27, 2025. The changes are unrelated to the FMCSA’s long-term and ongoing effort to revamp the entire CSA scoring process.
Unsafe Driving scores
As part of the recent update, the FMCSA says it tried to address an error in the way some carriers’ “measures” are calculated in the Unsafe Driving category. In essence, the “measure” is a weighted average of unsafe driving violations per power unit. The measure is then compared to that of other companies in the carrier’s peer group to determine a final percentile score from 0–100.
Most carriers (over 99.9%) have measures below 100. The FMCSA found that “erroneous data” was leading to measures of 3,000 or more for some unlucky companies. Aside from being a concern for the limited number of directly affected carriers, the problem was skewing the percentile scores for other carriers in the same peer groups.
To address the issue, the FMCSA has removed motor carriers with “excessively high” Unsafe Driving measures of 250 or greater from the percentile ranking and has assigned them the maximum score of 100. The FMCSA says this prevents these carriers from biasing the remaining carriers in the peer-group ranking process.
As of early October, there were 34 carriers with an Unsafe Driving measure over 250. Motor carriers assigned to the same peer groups as these 34 carriers may see changes to their Unsafe Driving score as a result.
Revised ELP violations
In response to recent changes in the way the ELP standard is enforced — it is now treated as an out-of-service (OOS) condition per an FMCSA enforcement memo issued in May — the FMCSA has changed the description of the three ELP violations tracked under CSA.
The violations include those for failing the interview, failing the sign assessment, and violating the ELP standard in a border zone (which is not treated as an OOS violation). They now read as follows (each carrying 4 CSA severity points):
- 391.11B2-Q: Driver cannot satisfy the English language proficiency requirements of 391.11(b)(2) as per FMCSA Enforcement Guidance Memo MC-SEE-2025-0001. Driver failed the Interview.
- 391.11B2-Z: Border Zone— Driver cannot satisfy the English language proficiency requirements of 391.11(b)(2) as per FMCSA Enforcement Guidance Memo MC-SEE-2025-0001.
- 391.11B2S: Driver cannot satisfy the English language proficiency requirements of 391.11(b)(2) as per FMCSA Enforcement Guidance Memo MC-SEE-2025-0001. Driver failed the Highway Traffic Sign Assessment.

38 ‘new’ violations
Finally, the recent CSA update included 38 violations added to the CSA violation tables, including:
- 3 under Driver Fitness,
- 5 under Hazardous Materials,
- 12 under Vehicle Maintenance, and
- 18 under Hours of Service.
Most of these “new” violations, however, are variations of those already tracked under CSA and were added due to changes in the software that officers use to record violations. Some vehicle- and hazmat-related violations, however, are indeed new to the list, including:
- 393.17B2LSLDMWR: Lighting— Stop Lamps— Driveaway— both missing when required (severity: 6)
- 393.45A-AHIL: Brakes— Air brake hose/tubing labeled for other than an air brake system (severity: 4)
- 393.45D-HHIL: Brakes— Hydraulic brake hose/line labeled for other than a hydraulic brake system (severity: 4)
- 393.45D-BHDB: Air Brake— Damaged by heat or broken (severity: 4)
- 393.45D-SGNCNB: Brakes— Service brakes on trailer inoperative due to service gladhand not connected (severity: 4)
- 393.70C-CDTDCE: Coupling— Full Trailer, drawbar eye cracked (severity: 3)
- 393.75A3-TALS: Tires— All others— Leaking in sidewall area on tire equipped with ATIS (severity: 8)
- 396.3A1E-PNCNB: Brakes— Electric brakes on trailer inoperative due to electrical cable unplugged (severity: 4)
- 171.2EHMGRMC: Accepting a hazardous material for transportation which is not properly classed, described, packaged, marked, labeled, and conditioned (severity: 2)
- 178.245-4: DOT51 integrity and securement (severity: 8)
Key to remember: The FMCSA has updated the CSA scoring system to account for errors in the scoring process, changes in English-language enforcement, and new violations being tracked.
