PHMSA again extends enforcement discretion for certain cylinders
On January 11, 2022, the Pipeline and Hazardous Materials Safety Administration (PHMSA) announced that it will not take enforcement action through May 16, 2022, against any person who fills a DOT-specification cylinder used to transport Division 2.2 non-flammable gas if the cylinder complies with all the Hazardous Materials Regulations (HMR, 49 CFR Parts 179-180) except that it is due for periodic requalification by no more than 12 months.
Previous extensions
PHMSA previously issued similar relief on April 6, 2020, due to the unprecedented disruptions in the supply chain occasioned by the COVID public health emergency, especially the need to provide medical gases to health care facilities.
On July 2, 2020, PHMSA extended the notice of enforcement discretion through October 31, 2020. Then, on December 30, 2020, PHMSA issued a similar notice of enforcement discretion that applied to cylinders containing certain medical gases; with that notice expiring on June 20, 2021. Finally, on September 13, 2021, PHMSA reinstated the notice of enforcement discretion through January 15, 2022, because of the prevalence of the Delta strain of the COVID virus and disruptions resulting from Hurricane Ida.
Supply chain difficulties continue
PHMSA is aware that the medical and industrial gas industry continues to have trouble obtaining cylinders due to COVID and further problems caused by the Omicron strain of the virus. This has made it difficult to obtain cylinders that can be filled in accordance with the requalification provisions specified in 49 CFR 173.301(a)(6) and 180.209.
Limitations of extension
The notice of non-enforcement is effective through May 16, 2022, and is limited to the filling and offering of cylinders containing Division 2.2 gases when such cylinders are no more than 12 months past their periodic requalification test date. Depending on the cylinder type, periodic requalification is required at either a 5-year or 10-year interval. All cylinders must comply with all other requirements of the HMR.
This enforcement discretion will be exercised by the Federal Motor Carrier Safety Administration and PHMSA. This relief applies only to transportation by motor vehicle, and does not extend to transport by air, vessel, or railroad.
Key to remember: Prior to filling and offering for transportation, all cylinders must still be inspected in accordance with the applicable Compressed Gas Association Pamphlet and DOT requirements. Any cylinder that does not pass the prefill inspection criteria must not be filled.
