On July 24, the U.S. Department of Labor’s Wage and Hour Division announced that it’s restarting a program known as the Payroll Audit Independent Determination program. The program allows employers to self-identify and resolve violations under the federal Fair Labor Standards Act and the Family and Medical Leave Act. Participants are chosen on a case-by-case basis. Employers that are selected can correct their FLSA and FMLA mistakes to help avoid costly litigation.
In other news, on July 25, members of Congress reintroduced a bill called the Protected Time Off Act. If passed into law, the PTO Act would mandate that employers give employees two weeks of accrued paid time off each year. This bill is in the first legislative stage, but is another reminder that members of Congress are interested in employee leave.
And finally, on August 5, a legislative voting package was introduced in Congress that includes a provision called the Time Off to Vote Act. This act would require employers with 25 or more employees to give them two consecutive hours of paid time off to cast their ballots in federal elections. If a state’s voting leave benefits are greater, employers would need to comply with the state law since it’s more beneficial to employees.
