6 updates to watch for on the new Form I-9

A new Form I-9 was released by U.S. Citizenship and Immigration Services (USCIS) on August 1, and employers can begin using it immediately.
The form has received a makeover, and employers should be alert to these changes:
- Section 2 has moved. Employers complete Section 2, which is used to record information about employee documents. On the previous version of the form, Section 2 was on the second page of the form. It’s now on the first page, right below Section 1 which is filled in by the employee.
- Preparers and translators use Supplement A. If an employee needs help filling out the form or needs information translated, an individual who acts as the preparer or translator enters their name, contact information, and signature on Supplement A. This information used to be on the bottom of Page 1. The supplement has space for four preparers or translators, but if more are needed another copy of the supplement can be used. There’s no limit to the number of preparers or translators who can provide assistance. When supplement A is used, it’s attached to the employee’s Form I-9.
- Supplement B is used for reverifications and rehires. Supplement B is completed when an employment authorization needs to be reverified. It can also be used when an employee is rehired within three years of filling out a Form I-9, or for a name change. This information used to be documented in Section 3 of the form. If Supplement B is needed, it’s attached to the employee’s Form I-9.
- Remote document review is an option for E-Verify employers. An employer participating in E-Verify, an online system that compares information entered on the Form I-9 to data in government records, has the option of reviewing employee documents via video rather than in-person. When this option is used, employers need to check the box in the Additional Information section that says, “Check here if you used an alternative procedure authorized by the DHS to examine documents.” Employers who are not participating in E-Verify need to examine documents in person and should not check this box.
- N/A is not necessary. Employers and employees no longer need to write N/A in the spaces that don’t apply. The spaces can simply be left blank.
- It’s easier to get information about document extensions. Sometimes an employee will present an employment authorization document that includes the date their employment authorization expires. This expiration date may be automatically extended, which means that the employee remains eligible to work for a certain amount of time past the date shown on the document. The extension time periods may fluctuate, so the USCIS has included a link on the bottom of the Lists of Acceptable Documents on Page 2 that goes to the Employment Authorization Extensions page on the I-9 Central website. This makes it easier to get the latest information on employment extensions.
Not everything is new
The latest version of the Form I-9 fulfills the same function as the previous version. It’s used to verify the identity and employment eligibility of new hires, and to reverify eligibility of current employees if certain documents have an expiration date.
Employers should be aware that these requirements still apply:
- Employees must complete and sign Section 1 of the form no later than the first day of work for pay.
- Employers need to complete Section 2 within three days after the employee’s first day of employment. If an individual is hired for less than three business days, Section 2 must be completed on the first day of employment.
- Employees get to choose which documents to present from the Lists of Acceptable Documents. They can present one document from List A, or one each from List B and List C.
- Only employers in Puerto Rico can complete the Spanish version, although all employers may use the Spanish version as a translation tool.
- Employers may be subject to penalties if the Form I-9 is not properly completed.
Key to remember: Employers can now use the new Form I-9 and must make sure it is completed properly.
