Here’s your chance to change the Hazmat regulations
If you ship or transport hazmat by highway, rail, air, or vessel and you think some changes are needed, now is your chance to give some input to change the regulations.
On July 5, 2023, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published an Advance Notice of Proposed Rulemaking (ANPRM) HM-265A. The Administration seeks feedback from those affected by the rules, with the goal of modernizing the Hazardous Materials Regulations (HMR) and improving safety and efficiency.
Topics under consideration for updates
PHMSA is requesting input on 46 specific hazmat topics. Many of these topics were included from previous rulemakings that stakeholders commented on. Now is your chance to submit your comments to influence the rules that affect your operations.
Topics that could have a major impact include:
General HMR
- Evaluation of carrier maintenance of emergency response information
- Residue intermediate bulk container (IBC) exceptions
- Non-bulk packaging, IBC, and large packaging periodic retest extension
- Aerosol classification alignment
- Requirements for damaged, defective, or recalled lithium cells and batteries
- Ex-number display requirements
- Ethyl alcohol exception in 173.150
- Limited quantity training exception
- Removal of the 60-day renewal requirement for approvals and special permits
- Design certifying engineer experience
Air regulations
- Oxidizing gases by air
Vessel regulations
- Part 176 vessel requirements update

Submitting comments
Any comments submitted for this ANPRM must be made by October 3, 2023. Comments can be made through the Federal Rulemaking Portal http://www.regulations.gov. If you plan to submit comments, make sure you include the agency name, docket number PHMSA–2019–0031 (HM–265A) or RIN (Registration Identification Number) 2137–AF47.
