Transportation Monthly Round Up - September 2023
Let's discuss the Advanced Notice of Proposed Rulemaking (ANPRM) for Safety Fitness Determination.
The Federal Motor Carrier Safety Administration (FMCSA) is taking another run at improving the Safety Fitness Determination (SFD) process for carriers operating in or affecting interstate commerce. The ANPRM was published in the Federal Register on August 29, 2023. Comments must be received on or before October 30, 2023.
This is the FMCSA's second attempt to revamp the safety rating methodology, the last time being in 2016 but they withdrew that attempt in 2017. According to FMCSA, the current SFD process is resource-intensive and reaches a small percentage of the over 750,000 active carriers in the United States.
The FMCSA requests public comments on the following items:
- The need for a rulemaking to revise the regulations prescribing the safety rating process,
- The available science or technical information to analyze regulatory alternatives for determining motor carrier safety fitness,
- Feedback on the agency's current safety rating regulations, and
- The available data and costs for regulatory alternatives that are likely to be considered.
Regulators are proposing significant changes to DataQs, the program that motor carriers and drivers use to challenge erroneous crash, inspection, or other data on their safety records.
If finalized, the changes would make it easier for motor carriers and drivers to appeal the decisions of state agencies when they refuse to correct disputed data.
The proposal would require agencies to accept appeals and have another party involved in reviewing any appeals. If the carrier is not successful and still believes the change should be made, they could appeal the decision to FMCSA. We will continue to follow this proposal closely and provide updates as they become available.
If you operate in Connecticut, take note. The state is changing the highway use fee reporting frequency from monthly to quarterly. The change begins with the fourth quarter of 2023.
The fourth quarter return, covering the period from October 1, 2023, through December 31, 2023, will be due January 31, 2024. The last monthly return is for September of 2023, and that return is due October 31, 2023.
The FMCSA has removed another electronic logging device (ELD) from its list of registered ELDs.
Due to a failure to meet the agency's ELD specifications, the FALCON ELD from Falcon Telematics was moved to the FMCSA's "revoked devices" list as of September 14, 2023.
Users will have 60 days to replace the device and November 13, 2023, is the deadline. It's the eighth ELD model revoked in 2023 and the tenth since the first device was revoked in June 2022. The FMCSA actually revoked another ELD on the same day as the FALCON device but reinstated it just four days later.
