Let’s start off this month by discussing recent FMCSA regulatory changes.
The new year is shaping up to be a busy one when it comes to DOT regulations. Changes to Drug & Alcohol Clearinghouse requirements, entry-level driver training, medical standards, and other safety mandates are all on the DOT’s rulemaking plan for 2024 and beyond. One controversial rule, to require CMVs to be equipped with an electronic ID, has been pushed to the backburner.
California’s new rule requiring the use of electronic logging devices for in-state drivers starting January 1, 2024, continues to generate tons of questions and confusion. We address five of the most frequently asked questions about California’s ELD mandate, including questions about exceptions, ELD specifications, and the short-haul provision in the link provided in the transcript.
The FMCSA revoked another 10 electronic logging devices from its list of acceptable units, doubling the total number of ELDs that were involuntarily revoked since the first one in the summer 2022. Though 2 of the 10 devices have since been reinstated, anyone using one of the remaining 8 ELD models has until January 30 to find a new solution. Otherwise, drivers risk being placed out of service.
The U.S. DOT has increased its maximum fines by 3.2 percent for the new year. This annual inflation adjustment affects all fines (or “civil penalties” as they’re known) levied by agencies within the DOT, including the Federal Motor Carrier Safety Administration and the Pipeline and Hazardous Materials Safety Administration. The increase went into effect on December 28, 2023.
