Each state manages Clean Air Act operating permits differently. Use the chart below to determine if additional requirements apply to your operations.
Title V of the Clean Air Act consolidates federally enforceable operating permit programs into one document and defines all applicable air pollution control requirements to which a “major” source is subject.
A major source is defined as a facility with the potential to emit 100 tons/year or more of a criteria pollutant, or a facility with the potential to emit 10 tons/year or more of a single hazardous air pollutant (HAP), or 25 tons/year or more of any combination of HAPs.

State | Adherence to federal regulations | State regulatory citation(s) | Differences from federal |
---|---|---|---|
Alabama | The Air Division has primary jurisdiction over all air emission sources within the State, except those emission sources located within Jefferson County or the City of Huntsville. The Air Pollution Control Programs in these areas are administered by the Jefferson County Department of Health
(https://www.jcdh.org/) and the City of Huntsville Department of Natural Resources
(www.huntsvilleal.gov/government/ departments/natural-resources/). | Code of Alabama §§22-28-1 – 22-28-23; ADEM Admin. Code, Div 335-3 | State information |
Alaska | Incorporates some federal regulations by reference. Alaska Department of Environmental Conservation, Division of Air Quality regulates state-specific requirements. | 18 AAC 50 | State information |
Arizona | Arizona Department of Environmental Quality (ADEQ) is not the only agency in Arizona that issues permits to air emission sources. Maricopa, Pima and Pinal counties, which have their own air pollution control agencies, have jurisdiction over stationary sources of air pollutants within their counties, except for refineries, copper smelters, coal-fired power plants, and Portland cement plants. These counties also have jurisdiction over portable sources of air pollutants that operate solely within their respective boundaries. Sources that will operate in multiple counties, or outside of the jurisdictions listed above, even for a short amount of time, must obtain permits from ADEQ. Facilities located on Indian lands in Arizona are under the jurisdiction of U.S. EPA. | (AAC) R18-2-326 (I) | State information |
