PHMSA reinstates enforcement discretion for cylinders
On September 13, 2021, the Pipeline and Hazardous Materials Safety Administration (PHMSA) reinstated a notice that it will not take enforcement action against anyone who fills a DOT-specification cylinder that has exceeded its periodic requalification test dates provided the cylinder is:
- Filled with Division 2.2 nonflammable gas,
- Not overdue for periodic requalification by more than 12 months,
- Compliant with all other aspects of the Hazardous Materials Regulations, and
- Only transported by highway.
Prior to filling and offering for transportation, all cylinders must be inspected in accordance with applicable Compressed Gas Association Pamphlet and PHMSA requirements. Any cylinder that does not pass the prefill inspection criteria should not be filled. This enforcement discretion expires on January 15, 2022.
Why reinstate the enforcement discretion?
The reinstatement of the enforcement discretion comes as there have been major supply issues caused by the Delta strain of the COVID-19 virus and recent disruptions resulting from Hurricane Ida. Both situations have led to an increased demand for certain nonflammable gases and a disruption in the normal business model for cylinder exchanges.
Background
Due to the initial strain on medical gases from COVID-19, PHMSA first issued a notice of enforcement discretion on April 6, 2020. PHMSA then extended the notice of enforcement discretion through October 31, 2020. On December 30, 2020, PHMSA issued a similar notice of enforcement discretion that applied to cylinders containing certain medical gases; that notice expired on June 20, 2021.
