Form I-9 updated with minor changes
Minor changes have been made to the Form I-9, but employers don’t need to switch to the new version just yet.
U.S. Citizenship and Immigration Services released an updated Form I-9 on April 2. The form has an edition date of 01/20/25 and an expiration date of 05/31/2027.
Employers can use the new version of the form or can continue to use previous versions of the form through their expiration dates:
- The 08/01/23 edition with an expiration date of 05/31/2027.
- The 08/01/23 edition with an expiration date of 07/31/2026.
What’s different about the 01/20/2025 version of the Form I-9?
The latest version of the Form I-9:
- Revises the wording in the fourth checkbox in Section 1 to refer to an “alien” authorized to work rather than a “noncitizen” authorized to work. (Section 1 is used by employees to attest to citizenship or immigration status.)
- Revises the descriptions of two List B documents on the List of Acceptable Documents to replace the term “gender” with “sex”.
- Revises the Department of Homeland Security (DHS) Privacy Notice in the instructions and adds statutory language. The form notes that the DHS may share the information provided on the form and any additional requested evidence with authorized organizations.
Changes made to E-Verify
The changes made on the Form I-9 are also reflected in the E-Verify system. Depending on the version of the form they are using, employers may see slight differences in the option chosen by the employee and the selections available in E-Verify:
- If an employee checks the box relating to a noncitizen authorized to work on the Form I-9, the employer must choose “An alien authorized to work” in E-Verify.
- E-Verify cases will display “An alien authorized to work,” even when an employer and employee see wording referring to a noncitizen authorized to work on the Form I-9 if the 08/01/23 edition is used.
- The employee status attestation will be automatically updated to “An alien authorized to work” for E-Verify users creating cases through Web Services applications even if “A noncitizen authorized to work” is submitted in the Web Services application.
- There will be an updated 01/20/25 edition date and 05/31/2027 expiration date on the Form I-9NG for E-Verify+ participants.
Key to remember: A new version of the Form I-9 is available, and employers can use the new version or previous versions through the expiration date noted on the form.
