Now is the time if you want FMCSA’s ear: Comments sought on proposed safety fitness determinations
The first of two virtual listening sessions on safety fitness determinations (SFD) was held on June 25th. Participants were asked to comment on 12 points of discussion related to how motor carriers are determined to be fit or unfit to operate, as previously published in a notice by the Federal Motor Carrier Safety Administration (FMCSA).
The agency proposes to replace its current safety rating process, which involves a compliance review (investigation) resulting in one of three safety ratings (satisfactory, conditional, or unsatisfactory). Instead, the agency would like to use motor carrier safety data to determine if a company is either fit or unfit.
What did stakeholders say?
During the June 25th event, virtual conference attendees provided a range of remarks, from the need to update the Safety Measurement System (SMS) Methodology prior to moving forward with SFD rulemaking to concerns over different levels of aggressive enforcement between states.
Others would like to see special consideration given to carriers who voluntarily implement best practices to improve safety, such as:
- Investment in data-driven, proven crash-prevention technologies;
- Corrective actions taken to address driver behavior;
- Hiring drivers with a good safety record; and
- Providing driver training.
More opportunities to join the conversation
If you missed the first virtual listening session, FMCSA is hosting:
- An in-person listening session on June 29, 2024, at the Texas Trucking Show in Houston, TX; and
- A second virtual listening session on July 31, 2024.
In addition, FMCSA is accepting comments in the Federal Docket (regulations.gov) through August 7, 2024. When submitting comments, refer to FMCSA’s original notice using either Docket FMCSA-2022-003 or RIN 2126-AC52. The agency will review all comments and feedback to determine further steps, which may include a formal proposal to change the regulations.
