How you mark rented vehicles matters
Only one entity can be responsible for compliance on a rented vehicle, and enforcement must know who the responsible motor carrier is to attribute violations and crashes.
When renting a commercial motor vehicle (CMV) for more than 30 days, the vehicle must be marked with the carrier’s legal name and USDOT number.
What if the leasing company’s name is permanently on the vehicle?
The leasing company’s name doesn’t necessarily need to be covered if it permanently appears on the vehicle. However, their USDOT number must be covered because they are not the motor carrier. As a result, they are not responsible for complying with the safety regulations relating to the vehicle or driver.
If the rental company’s name is not covered, you need to include the words “Operated by” before your name in accordance with 49 CFR 390.21(b)(3).
What about short-term rentals?
There is a marking exception for short-term rentals found in 390.21(e). To use the exception, the following conditions must be met:
- The rental must be for a period of 30-days or less;
- The vehicle must be properly marked with the rental company’s legal name and USDOT number;
- The rental agreement entered into by the lessor and the renting motor carrier conspicuously contains the following information:
- The name and complete physical address of the principal place of business of the renting motor carrier; and
- The identification number issued to the renting motor carrier by the FMCSA, preceded by the letters “USDOT”; and
- The following sentence: “This lessor cooperates with all Federal, State, and local law enforcement officials nationwide to provide the identity of customers who operate this rental CMV”; and
- The rental agreement is carried on the rental CMV during the full term of the rental agreement.
Note that even though the rental company’s name is on the vehicle, the carrier still runs under their own USDOT number. Any violations (including vehicle violations) belong to the carrier regardless of how the vehicle is marked because they are the responsible motor carrier.
