3-question quiz helps answer “Is your pickup truck a CMV?”
Your company pickup truck just might be defined as a commercial motor vehicle (CMV) according to the safety regulations.
When determining whether the vehicle is regulated under the Federal Motor Carrier Safety Regulations (FMCSRs), arguments that you’re not a for-hire carrier or that the vehicle doesn’t require a commercial driver’s license don’t apply. If your vehicle qualifies as a CMV, you must meet all applicable regulations to avoid fines.
CMV quiz
There are specific variables that determine whether your company’s smaller property-carrying vehicles are actually CMVs as defined in 390.5. Take the following quiz to help define your fleet:
- Does your truck weigh or have a weight rating of 10,001 pounds or more?
- If yes, it is a CMV.
- If no, go to question 2.
- Is a trailer attached so the combined weight or weight rating is at least 10,001 pounds?
- If yes, it is a CMV.
- If no, go to question 3.
- Are you transporting hazmat in quantities requiring placarding?
- If yes, it is a CMV.
- If no, it is not a CMV.
OK, it’s a CMV. Now what?
If you find that your pickup meets the CMV definition, then whoever drives this vehicle must be qualified under Part 391 and comply with hours-of-service regulations. You may need an electronic logging device (ELD) unless you are claiming one of the exceptions.
The pickup truck and any trailer you attach to the truck are also subject to vehicle inspection and maintenance rules, including:
- USDOT marking requirements,
- Cargo securement rules,
- Equipment rules,
- Daily pretrip and post-trip vehicle inspections, and
- Annual inspections
You are also expected to present maintenance records on the truck (and trailer) in the event of an audit.
Additionally, the pickup may have to stop at roadside inspection stations dependent upon state requirements.
Side note
If the vehicle only meets the definition of CMV when pulling a trailer, you only need to observe the safety regulations on those days it meets the criteria. This includes USDOT markings on the side of the truck, a qualified driver, and so forth.
