- USERRA provides a variety of protections from discrimination to reemployment.
- Employers must be aware of the protections to ensure compliance.
The Uniformed Services Employment and Reemployment Rights Act (USERRA) guarantees employees returning from military service or training the right to be reemployed at their former job (or as nearly comparable a job as possible) with the same benefits. USERRA, therefore, regulates how employers deal with:
- Reemployment
- Promotions
- Retraining
- Vacation
- Health benefits
- Compensation
- Retirement benefits
- Termination
When employees return from service, employers must:
- Reemploy them;
- Preserve their seniority status and benefits; and
- Refrain from discriminating against them regarding hiring, retention, and promotion.
