FMCSA issues 20 rulemaking actions
In an effort to ease regulatory burden and eliminate obsolete requirements, the Federal Motor Carrier Safety Administration (FMCSA) has issued 20 rulemaking actions. The 2 final rules and 18 proposed rules, to be published on May 30, address issues ranging from driver qualification to vehicle parts and accessories.
Final rules
The final rules make procedural changes to the Federal Motor Carrier Safety Regulations (FMCSRs).
- Civil penalties: FMCSA has amended the civil penalty schedule in the regulations to remove the reference to Part 40, the DOT’s “Procedures for Transportation Workplace Drug and Alcohol Testing Program.”
- Motor carrier routing: FMCSA has repealed Part 356, the for-hire motor carrier routing regulations based around servicing municipalities and unincorporated communities.
Proposed rules
The proposed rules address several areas of the FMCSRs. The proposed changes include:
- Accident reporting: This proposal would revise the term “medical treatment” for the purpose of accident reporting by incorporating revised regulatory guidance from FMCSA regarding medical treatment away from the scene of the accident.
- Commercial driver’s license (CDL) standards:This proposal would allow dual-status military technicians to qualify for the exception from license standards for certain military personnel.
- Driver vehicle examination report disposition: Under this proposed change, motor carriers and intermodal equipment providers would only need to sign and return completed roadside inspection forms to the issuing state agency when requested by the agency.
- Electronic driver vehicle inspection reports: This proposal clarifies that driver vehicle inspection reports (DVIRs) may be completed electronically.
- Electronic logging device (ELD) operator's manual located in commercial motor vehicles: This proposal would remove the requirement that drivers carry an ELD operator’s manual in the commercial motor vehicle (CMV).
- Vision standards grandfathering provision: This proposal would remove an expired grandfathering program addressing vision waivers. (391.64)
- Railroad grade crossings; stopping required: This proposal would remove the requirement that certain CMVs stop at a crossing when there’s no light or gate activated.
- Removal of obsolete references to "water carriers": This proposal would remove all obsolete references to “water carriers” in the regulations.
- Self-reporting requirement: This proposal would eliminate the requirement that CDL holders self-report motor vehicle violations to their home state.
There are also nine proposals addressing various parts and accessories requirements, including a proposal to remove the requirement that spare fuses be carried on a CMV and the requirement that a CMV’s rear impact guard be permanently marked or labeled with a certification from the impact guard manufacturer.
