Document your drivers’ use of med-card and CDL waivers
Did your drivers take advantage of the pandemic-related waivers for renewing their medical cards or driver’s licenses? If so, be sure you document it. Now that the pandemic seems to be winding down, those waivers are coming to an end, expiring on May 31. You’ll need the right documentation to show that your drivers were in compliance at all times.
For medical-card waivers
Drivers using a med-card waiver were/are required to obtain a new medical card by the deadline shown below.
If a driver claimed this waiver, your records should include the following until three years after the date the driver was able to obtain a new medical certificate:
- A copy of the FMCSA waiver(s) that applied.
- A copy of the expired medical card.
- Evidence that the expired card was good for at least 90 days.
- Evidence that a new card was obtained by the deadline shown above (i.e., the new medical card or (for a CDL driver) a driving record showing the latest medical information).
- No evidence that the driver developed a disqualifying medical condition while operating on an expired card.
- Documentation of the reasons the driver was unable to obtain a new medical card (e.g., the clinic was closed) as well as any efforts made to find an available examiner.

For CDL/CLP waivers
Drivers with a CDL or commercial learner’s permit (CLP) in good standing that expired on or after March 1, 2020, were given until May 31, 2021, to renew it. Note that the licensing waiver was optional for states. Therefore, drivers were expected to renew their license as soon as their home state required it.
Documentation you should have on hand for drivers who used the CDL/CLP waiver includes:
- A copy of the FMCSA waiver(s) that applied.
- A copy of the expired license and the date it was finally renewed.
- Screenshots of the state licensing agency website, or notes from phone conversations with that agency, showing that drivers were unable to renew their licenses until a specified date.
- A driving record (MVR) showing that the expired license was brought up to date and is valid. This should be obtained prior to June 1, 2021.
Drivers should not wait
Drivers themselves should not wait until the last minute to renew their license or medical card. In fact, drivers should plan to renew their license or permit and provide an updated medical card to the licensing agency no later than May 18, 2021. This will give the state time to update the driving record, give your company time to get an updated MVR before June 1, and help avoid state office closures over Memorial Day weekend (May 29-31).
