Delaware paid leave provisions amended

This applies to: Employers with 10 or more employees in the state during the previous 12 months
Description of change: On July 30, Delaware Governor Matt Meyer signed HB128 into law, amending the state’s paid leave law before it becomes effective on January 1, 2026. The new law makes the following changes:
- The Delaware paid leave is the primary payor of benefits. Employers with disability insurance benefits should know that the disability benefits may be offset by Delaware's paid leave, per the terms of the disability policy. Other available income replacement benefits must be coordinated with the paid leave benefits according to the terms of the policy or procedure governing other available benefits.
- Employers may not require employees to use their accrued paid time off before receiving paid leave benefits. Both employers and employees must agree to use accrued paid time off to top off or supplement the paid leave benefits.
- Employers with private plans must apply for plan renewal with effective dates of January 1, April 1, July 1, or October 1 instead of renewing plans only between September 1 and December 1 every year.
