Audit exposes serious lack of regulatory knowledge
“We didn’t know” is not a valid defense during a Federal Motor Carrier Safety Administration (FMCSA) investigation.
A recent enforcement case demonstrates that FMCSA can and does cite motor carriers for violating 390.3T, a high-level regulation requiring everyone at the motor carrier know and comply with the Federal Motor Carrier Safety Regulations (FMCSRs).
Investigation results in egregious violations
The carrier involved in the enforcement action was audited following a deadly crash. The investigation revealed egregious noncompliance with several FMCSRs, including driver files, hours of service, commercial driver’s licensing, and vehicle inspection and maintenance. As a result of the review, the carrier was ordered to shut down.
The responses provided by the motor carrier’s owner to FMCSA about the violations indicated an obvious violation of 390.3T.
A lack of understanding
FMCSA noted that the motor carrier’s owner lacked a basic understanding of and regard for the FMCSRs.
The out-of-service order indicated that the owner:
- Threw away vehicle maintenance records, explaining it was just a bunch of paperwork that no one keeps anymore; and
- Was unfamiliar with driver qualification (DQ) and drug and alcohol testing requirements. He didn’t realize he must test drivers and maintain DQ files.
As a result, the carrier was cited with 390.3T. To resume operations, the carrier was given 14 specific steps to ensure and demonstrate compliance with the regulations. Many included establishing safety management controls and procedures for areas of noncompliance.
One on the list read, “In accordance with 49 CFR § 390.3T(e), you must be knowledgeable of and comply with the federal motor carrier statutes and regulations.”
Key to remember: Whether you are the owner of the company, a dispatcher, or a driver, everyone must understand and comply with the FMCSRs.
