Tier II forms due soon — Are you ready?
The annual Tier II reporting deadline is rapidly approaching. Due March 1 each year, the Tier II report is required for all locations that stored hazardous substances above the applicable threshold at any one time during calendar year 2020. Reports include specific information on the amounts and locations of the chemicals at each applicable facility.
Keep the following in mind as you create the reports:
- Confirm what the reporting process is for your location(s). Many states now require electronic reporting in addition to sending the reports to Local Emergency Planning Committees.
- If electronic reporting is required, registration may be the first step for online system access. Get that done right away to ensure you meet the March 1 deadline.
- Gather required information and attachments ahead of time to streamline the process of completing the report (whether online or on paper).
It isn’t too late to get started with Tier II reports, but the deadline will be here before you know it, so don’t delay!
Background
Section 312 of the Emergency Planning and Community Right-to-Know Act (EPCRA) and EPA regulation 40 CFR 370 establish the requirement for annual submittal of the Emergency and Hazardous Chemical Inventory Form to state and local officials and local fire departments. Facility owner or operators must submit the inventory form (or Tier II report) if any of the following conditions is met:
- An extremely hazardous substance (EHS) is present at the facility at any one time in an amount equal to or greater than 500 pounds or the threshold planning quantity (TPQ), whichever is lower.
- A hazardous chemical that is not an EHS is present at the facility at any one time in an amount equal to or greater than the following threshold levels:
- Any hazardous chemical that does not meet the criteria in (2) or (3) below, quantities greater than 10,000 pounds (or 4,540 kg). For gasoline at a retail gas station, above 75,000 gallons, but only under conditions listed at 40 CFR 370.12(a)(2)(ii).
- For diesel fuel at a retail gas station, quantities above 100,000 gallons, but only under conditions listed at 40 CFR 370.12(a)(2)(iii).
