E-Verify employers may wonder where their posters are
Many employers update workplace labor law posters on January 1, and those who participate in E-Verify may wonder if something is missing from an all-in-one poster they received from a poster supplier.
E-Verify employers use the electronic system to verify that their employees are eligible to work in the United States. They are required to display certain posters that let applicants and employees know this. The catch is that the E-Verify poster can’t be sold. This means that a poster purchased from a poster supplier should not include this posting.
Complying with the E-Verify posting requirement
To comply with the E-Verify posting requirement, an employer enrolled in the system must first log in with a username and password. The employer can then navigate to the View Essential Resources area.
The employer can then download and print the required posters:
- Notice of E-Verify Participation, and
- Right to Work
E-Verify posting language requirement
The E-Verify and Right to Work posters must be displayed in English and Spanish. To fulfill this part of the posting requirement, employers must make sure they have downloaded and printed three posters:
- One E-Verify poster, which is bilingual and includes the required English and Spanish information.
- Two Right to Work posters, one in English and one in Spanish.
Commercial sale prohibited
To find the statement prohibiting the sale of the E-Verify poster, look at the bottom of the E-Verify Participation poster. It states that “Commercial sale of this poster is strictly prohibited.”
Appropriately posting the E-Verify poster
Employers who are using the E-Verify system must display the E-Verify and Right to Work posters where they are clearly visible to applicants and employees. This makes them aware that the employer is using the E-Verify system to verify the employment eligibility of its workers.
The federal government also recommends that E-Verify employers provide a copy of the posters with job application materials. This can be done by posting them electronically on the employer’s website listing job openings or providing a hard copy of the posters.
Key to remember: Employers participating in E-Verify must display required posters, but commercial sale of the E-Verify Participation Notice is prohibited.
