OSHA recommends $393K in fines as plant persists in endangering workers
The U.S. Department of Labor has raised the alarm over its finding of ongoing risks faced by workers at a chemical plant in Missouri. Despite a previous inspection less than two years ago that uncovered 24 serious safety and health violations, the Occupational Safety and Health Administration (OSHA) conducted a follow-up inspection and uncovered an additional sixteen violations.
Among these violations are hazardous conditions that expose employees to toxic substances such as ethylene oxide. This substance can lead to severe health effects, such as cancer. The agency has also sent a hazard alert letter to address inadequate medical evaluation procedures for workers with exposures to ethylene oxide.
As a result of the inspection, OSHA has issued four repeat and nine serious safety and health violations to the company. The proposed penalties amount to $393,798.
OSHA’s maximum penalty structure is as follows:

- Inadequate process safety management (PSM) procedures and monitoring;
- No emergency evacuation plan;
- Insufficient training for workers on actions to take during a chemical release;
- Respirators in storage exposed to ethylene oxide while in storage; and
- Failure to address electrical safety hazards.
Karena Lorek, the OSHA Area Director in Kansas City, Missouri, voiced concern over the company's failure to address previous violations and comply with OSHA regulations. Ethylene oxide is a colorless and flammable gas that poses significant risks to human health, and the company must prioritize the safety and well-being of its employees in light of these risks. Lorek emphasized the need for the company to correct its monitoring procedures immediately and re-evaluate its engineering processes to ensure the safety and health of its workforce.
