It's a rule: Inspect rear bumpers!
In the November 9 Federal Register, FMCSA added rear impact guards to the list of criteria for passing an annual vehicle inspection, effective December 9. The criteria, found at 49 CFR 396 App. A, include details on the condition, placement, and size of the bumper, depending on vehicle type/year of manufacture. This new final rule means your inspectors/technicians will need to be familiar with the bumper inspection standards. It also means your annual inspection forms will need to include the rear impact guard inspection item.
As part of the new rule, FMCSA also revised §393.86 to allow the DOT certification label to be placed on either the front or back side of the horizontal beam on an underride guard. This permanent label is applied by the bumper manufacturer, not motor carriers. The rule also exempted road construction controlled horizontal discharge trailers from needing a rear underride guard.
Editor Note: Please note that according to the Commercial Vehicle Safety Alliance (CVSA) Operational Policy 15, roadside enforcement officers are not supposed to cite drivers for missing underride guard labels. It is our understanding that a missing or obscured label on a rear impact guard will not cause a roadside violation nor a failed annual inspection.
