Construction contractors have a new way to report awards
In late August 2022, the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) launched an online portal designed to help contracting officers, contractors, and subcontractors to provide required notices of federal construction contracts and subcontract awards. The portal can be found at ncap.dol.gov. While contractors are encouraged to use the portal, they are not mandated to do so.
The Notification of Construction Contract Award Portal (NCAP) provides users with an efficient and secure way to submit required information about contract awards, including the contract’s effective date.
Under Executive Order 11246, federal construction contractors are required to give written notice to OFCCP within 10 working days of awarding a construction subcontract of more than $10,000 at any tier for construction work performed under a federal or federally assisted construction contract. This notice requirement is in OFCCP’s construction regulations at 41 CFR 60-4.2(d)3.
Federal contracting officers, applicants for construction contracts, and in some cases nonconstruction contractors are also responsible for providing this notice. Nonconstruction contractors are subject to this requirement if the construction work is necessary in whole or in part to the performance of the nonconstruction contract. The notice requirement for contracting officers, applicants, and nonconstruction contractors is in OFCCP’s construction regulations at 41 CFR 60-4.2(c), while the requirement for construction contractors can be found at 41 CFR 60-4.2(d)3.
The information contractors submit is broken into three categories:
- Contract information,
- Contract receiving entity, and
- Contract place(s) of performance.
This includes the prime contract number, contracting officer information, dollar amount of the contract, estimated start and completion dates of the contract, contact information, the contract awarding entity, EIN, and geographical area contract is to be performed.
The portal will be the primary source for entering, tracking, and submitting contract award notifications for OFCCP review. The site is designed to reduce or eliminate the need to submit contract award notifications by mail or email. It indicates when the information has been submitted successfully.
The NCAP is separate from the supply and service Contractor Portal for AAP certification, as that portal does not apply to construction contractors. It is also separate from the portal federal contractors may use to object to disclosure of EEO-1 Report information under the Freedom of Information Act request (OFCCP Submitter Notice Response Portal).
Key to remember: Federal construction contractors have a new way to submit contract award information that can be faster than mail or email.
