Board urges UCR enforcement at roadside inspections
Enforcement personnel may be paying closer attention to compliance with Unified Carrier Registration (UCR) requirements during roadside inspections this year.
A bulletin published recently by the Commercial Vehicle Safety Alliance (CVSA) and directed to enforcement personnel:
- Provides guidance to verify compliance with the UCR during a roadside inspection, and
- Encourages roadside enforcement for the 2022 registration year.
CVSA went even further and provided officers with a list of evidence to look for that shows violations of registration requirements for last year.
And it looks like there will be no grace period for this registration. The UCR Board is recommending that states begin enforcement for the 2022 registration year on Jan. 1, 2022.
Any non-compliance of UCR fees will be documented and the driver issued a citation. The violation code in the inspection software indicating that a carrier is not in compliance with UCR is 49 CFR 392.2 UCR - Failure to pay UCR fees.
Who is subject to UCR?
All motor carriers (for-hire, private, and exempt), as well as brokers, freight forwarders, and leasing companies, operating in interstate and international commerce are subject to the UCR Agreement. Carriers based in Canada and Mexico that operate in United States are also subject to the requirements.
Three types of carriers are not subject to UCR fees:
- Entities that receive USDOT numbers under the PRISM program as “registrants” but have no interstate operating authority;
- Purely intrastate carriers, that is, those that do not handle interstate freight or make interstate movements, (unless the State has elected to apply the provisions of the UCR Agreement to those intrastate carriers); and
- Motor private carriers transporting passengers in interstate commerce (e.g., church buses).
Register annually to operate interstate
Each covered entity must submit an annual filing, pay the fees, and be registered before operating in interstate commerce.
Your UCR fee is based on the number of commercial vehicles owned or operated. This can be:
- The number of CMVs reported on your last MCS-150 form filed with Federal Motor Carrier Safety Administration (FMCSA), or
- The total number of vehicles owned and operated for the 12-month period ending June 30 of the year immediately prior to the year for which the UCR registration is made.
The number of vehicles includes all vehicles owned and/or leased (term of lease for more than 30 days).
Each year, the UCR filing period opens October 1 with registration fees due by December 31.
