The federal Fair Labor Standards Act (FLSA) requires employers to pay non-exempt employees 1.5 times their pay for any hours worked beyond 40 in a workweek.
State laws can provide greater employee benefits beyond the FLSA.
If a state does not have a related law, the federal FLSA will apply. If a state does have a related law, both the state law and the federal FLSA can apply. Employers need to give employees the greater protection afforded by a particular provision of the state or federal law.
