According to state law, a truck or bus driver subject to the Federal Motor Carrier Act shall be paid overtime for hours worked over 40 hours per week. employee is not paid on an hourly basis, a rate of pay may be determined by an alternate formula, as long as the total compensation reflects an equivalent amount of compensation for overtime. A sample alternative formula can be found in the state statute at the link below.
