A 2019 ruling from the U.S. District Court for the Eastern District of New York held that the New York Labor Law’s overtime-pay provision entitles certain exempt employees from overtime pay. The ruling states that employees who are exempt from overtime pay under federal law, such as those under the Motor Carrier Exemption of the Fair Labor Standards Act, are nevertheless entitled to overtime pay in the state of New York at the rate of 1-1/2 times the minimum wage.
