Minors and individuals with disabilities

- A parent or legal guardian may present List B identity documents for a minor by completing Section 1 and filling out the appropriate fields.
- Individuals with disabilities may establish identity without a List B document by having a representative, parent, or legal guardian and the employer fill out the Special Placement components (and other appropriate fields) in Sections 1 and 2.
In some cases, a minor or individual with a disability will not be able to present a List B document establishing identity.
Minors
If a person under the age of 18 cannot present an identity document from List B, a parent or legal guardian may establish identity for the minor.
To do this:
- The minor’s parent or legal guardian completes the minor’s information in Section 1 and checks the box by the minor’s status;
- The parent or legal guardian enters “minor under age 18” in the signature field;
- The parent or legal guardian completes Supplement A, Preparer or Translator Certification for Section 1;
- The employer enters “minor under age 18” under List B and records the List C document the minor presents;
- The employer reads “Certification” paragraph and enters the date employment began;
- The employer attests to examining the documents provided by signing and dating the signature and date fields, and by printing their own name in the fields below the signature; and
- The employer enters the business name and address.
If the employer participates in E-Verify, the employee must present a List B identity document with a photograph.
Individuals with disabilities
People with a physical or mental impairment who are placed in a job by a nonprofit organization, association, or as part of a rehabilitation program may still establish identity under List B without an identity document. This can be done even if they cannot produce a List B document but still qualify to use the procedures.
To do this:
- In Section 1, a representative of a nonprofit organization, association, or rehabilitation program, parent, or legal guardian:
- Enters the employee’s information and correct immigration status,
- Enters “Special Placement” in the signature field, and
- Completes Supplement A, Preparer or Translator Certification for Section 1.
- In Section 2, the employer:
- Enters “Special Placement” under List B and records the List C document that the employee with a disability presents;
- Reads “Certification” paragraph and enters the date employment began;
- Attests to examining the documents provided by signing and dating the signature and date fields, and by printing their own name in the fields below the signature; and
- Enters the business name and address.
