North Dakota has adopted Part 395 of the Federal Regulations.
Applicability
Part 395 applies to intrastate commercial motor vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight, and gross combination weight rating of 26,001 pounds or more, or a vehicle used to transport hazardous materials requiring a placard.
Exception — An intrastate driver may not drive more than 12 cumulative hours following 10 consecutive hours off duty or for any period after the end of 16th hour after coming on duty. A driver may not drive after having been on duty 70 hours in 7 consecutive days.
Exception — Hours-of-service limitations do not apply to an intrastate driver transporting agricultural commodities or farm supplies, including farm equipment or machinery, for agricultural purposes during planting and harvesting seasons, if the transportation is limited to an area within a 150 air-mile radius from the source of the commodities or the distribution point for the farm supplies.
North Dakota’s planting and harvesting season is January 1 through December 31 of each year.
Exception — An intrastate driver is exempt from maintaining a record of duty status if:
- The driver operates within a one hundred fifty air-mile radius from the driver’s normal work reporting location or from the official worksite of the vehicle;
- At least ten consecutive hours off duty separate each twelve hours on duty;
- The driver, except for a driver salesperson, returns to the work reporting location and is released from work within twelve consecutive hours; and
- The motor carrier maintains and retains for a period of six months accurate time records showing the time the driver reports for duty and is released from duty each day.
Electronic logging device (ELD)
North Dakota has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
