Employers aren’t actually required to do anything when an employee changes his or her name, but the United States Citizenship and Immigration Services (USCIS) recommends that employers do note any name changes in Supplement B of the form. No documentation is required to prove that the employee has changed his or her name, but the employer may take steps to be reasonably assured of the employee’s identity and the validity of the name change.
If provided by the employee, the employer may accept evidence of the name change to keep with the Form I-9.
