Per 40 CFR 280.244, when the implementing agency finds operators of UST systems to be out of compliance, Class A and Class B operators must complete a retraining program or comparable examination in compliance with the training requirements in 280.242.
At a minimum, the training program or comparable examination must:
- Cover the area(s) determined to be out of compliance;
- Be developed or administered by an independent organization, the implementing agency, or a recognized authority; and
- Be completed within 30 days from the date the implementing agency determines the facility is out of compliance.
There are two exceptions for which the retraining requirement doesn’t apply. Either:
- Class A and Class B operators take annual refresher training that covers all applicable training requirements in 280.242, or
- The implementing agency waives this retraining requirement for Class A or Class B operators or both.
