What are the retraining requirements for tank operators when an underground storage tank (UST) is out of compliance? Are there any exceptions?

Per 40 CFR 280.244, when the implementing agency finds operators of UST systems to be out of compliance, Class A and Class B operators must complete a retraining program or comparable examination in compliance with the training requirements in 280.242.

At a minimum, the training program or comparable examination must:

• Cover the area(s) determined to be out of compliance;
• Be developed or administered by an independent organization, the implementing agency, or a recognized authority; and
• Be completed within 30 days from the date the implementing agency determines the facility is out of compliance.

There are two exceptions for which the retraining requirement doesn’t apply. Either:

• Class A and Class B operators take annual refresher training that covers all applicable training requirements in 280.242, or
• The implementing agency waives this retraining requirement for Class A or Class B operators or both.
